Public offer for a voluntary charitable donation
This offer is addressed to an indefinite number of persons – individuals and legal entities – visitors to the site on the Internet: www.lifelineukraine.com (hereinafter referred to as the site), hereinafter referred to as the "benefactor", and is an official and public offer to the charitable organization "Charitable Foundation "Lifeline of Ukraine", hereinafter referred to as the "Foundation", represented by director Paul Nayland, acting on the basis of the Charter, to conclude a charitable voluntary donation agreement (hereinafter referred to as the agreement), the subject matter and essential terms of which are specified below:
Terms and definitions
Acceptance-full and unconditional acceptance of a public offer by performing actions to make a money transfer using payment forms and funds posted on the site, as well as by transferring funds to the fund's current account through bank institutions. The moment of acceptance is the date when funds are credited to the fund's current account. Payment-a voluntary charitable donation. Voluntary charitable donation-a money transfer made by a benefactor to achieve the goals, objectives, directions and types of statutory activities of the foundation in accordance with the agreement and the law of Ukraine "on charitable activities and charitable organizations".
Subject of the agreement
The subject of this agreement is the gratuitous transfer of funds by the benefactor in favor of the fund to achieve the goals, objectives, directions and types of statutory activities of the fund. Acceptance of the contract means that the benefactor agrees with all its provisions, he is fully aware of the subject matter of the contract and the purpose of collecting donations. The agreement is concluded by unconditional and full accession of the benefactor to this Agreement and acceptance of all essential terms of the agreement. The benefactor and the foundation, guided by Article 207, Part 2 of Article 639, articles 641, 642 of the Civil Code of Ukraine, Article 7 of the law of Ukraine "on charitable activities and charitable organizations", agree that the contract is considered concluded in writing without signing a written copy by the parties from the moment The Benefactor performs the actions provided for in the contract, indicating consent to comply with the terms of the contract. The agreement is posted on the website www.lifelineukraine.com freely available and in a way that ensures familiarization with the content of this Agreement for each person applying to the fund. The benefactor cannot offer its own terms of the contract.
Rights and obligations of the parties
The foundation has the right to:
- Receive voluntary charitable donations and use them to achieve the goals, objectives, directions and types of statutory activities of the foundation in accordance with the agreement and the law of Ukraine "on charitable activities and charitable organizations".
- At the request of the benefactor, provide a report on the voluntary charitable donation received and its use.
The benefactor has the right to:
- Transfer a voluntary charitable donation to the fund's account in the manner specified in the agreement;
- Request a report on the use of a voluntary charitable donation.
Fundraising venue
Collection of voluntary charitable donations is carried out on the territory of any of the countries of the world.
Fundraising period
The collection of voluntary charitable donations continues until the foundation is liquidated, unless another period is determined by the foundation.
General access to the fund's reports
Access to the fund's reports is made by contacting the fund's management at the address indicated on the website www.lifelineukraine.com. Other information may be provided by the Fund in accordance with the procedure and within the time limits stipulated by the legislation of Ukraine.
Other conditions
All expenses related to the transfer of the donation are borne by the benefactor. The benefactor independently determines the amount of a voluntary charitable donation. The donation is voluntary and non-refundable. The benefactor is responsible for the accuracy of the information provided when transferring the donation. In order to comply with the law of Ukraine "on personal data protection" and properly fulfill the terms of the contract, the benefactor agrees to the processing of personal data. The provisions of Ukrainian legislation apply to relations between the benefactor and the foundation.
